The application proposes 72 social and affordable dwellings across Levels 1 to 9, commercial tenancies and resident amenities at ground floor level, a public access link to the right-of-way, and a total of 24 car parking bays which are accessed via the right-of-way. The development is proposed to be owned and operated by a Community Housing Provider.
The Bayswater Design Guidelines (the Guidelines) enable departures from the Acceptable Outcome criteria where it is demonstrated the alternative design solutions meet the relevant character statements and objectives of the Guidelines. The application proposes -
• The proposed height of 9 storeys (up to 30.9 metres) which exceeds the envisioned height of 8 storeys (up to 25 metres);
• Twenty four (24) parking bays for commercial, visitor and residential parking, in lieu of 76 parking bays;
• The development does not achieve the boundary setbacks envisaged under the applicable Acceptable Outcomes:
o the tower element (Levels 8–9) setback 3 metres in lieu of 9 metres; and
o visual privacy setbacks of 3 metres in lieu of 9 metres to Levels 4–8.
